Terms of Service

1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and HerTide Health ("HerTide Health," "we," "our," or "us") and govern your access to and use of the website at hertide.expand.health, our telehealth platform, and all related products and services (together, the "Services"). By creating an account, completing an assessment, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where required, notify you. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old and physically located in a U.S. state where HerTide Health PLLC's physicians are licensed to use the Services. The Services are intended for individual, personal use. You agree that the information you provide during registration and assessment is accurate, current, and complete, and that you will keep it up to date.
3. Nature of the Services
HerTide Health operates a technology platform that connects patients with independent, licensed physicians for telehealth evaluation and, where clinically appropriate, treatment for the symptoms of perimenopause and menopause. Medical services are provided by HerTide Health PLLC, an independently owned professional medical practice, and its licensed physicians. Pharmacy services, including compounding and dispensing, are provided by BoomRx, a licensed pharmacy. HerTide Health does not itself practice medicine or pharmacy.
Using the Services does not guarantee that you will be prescribed any particular medication or therapy. A physician may determine that a requested treatment is not appropriate for you. Prescribing decisions are made solely by the treating physician based on their independent medical judgment.
4. Not for Emergencies
The Services are not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use the Services to request emergency care.
5. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate your account if we believe it has been compromised or if you violate these Terms.
6. Subscriptions, Billing, and Cancellation
Some Services are offered on a recurring subscription basis. By starting a subscription, you authorize us or our payment processor to charge the payment method on file on a recurring basis until you cancel. Prices, fees, and what is included are shown at checkout.
You may cancel a subscription at any time from your account or by contacting support. Cancellation stops future charges and shipments. Unless required by law, fees already charged and orders already shipped or compounded for you are non-refundable, because compounded medications are prepared specifically for you and cannot be resold.
Consultation fees pay for a physician's time and evaluation, not for a guaranteed prescription, and are non-refundable once the evaluation has been performed.
7. Acceptable Use
You agree that you will not:
- Provide false, misleading, or incomplete health or identity information.
- Resell, share, or divert any medication prescribed to you to another person.
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to the platform, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Services.
8. Intellectual Property
The Services, including all content, software, trademarks, and design, are owned by HerTide Health or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended personal purpose. You may not copy, modify, distribute, or create derivative works from the Services without our written permission.
9. Disclaimers
Except for the professional medical services provided by licensed physicians, the platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the platform will be uninterrupted, error-free, or secure. Information published on the website is for general educational purposes and is not a substitute for individualized medical advice from your treating physician.
10. Limitation of Liability
To the fullest extent permitted by law, HerTide Health and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for the professional negligence of a treating physician.
11. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.
